Rental Review Board
The Rental Review Board is a seven-member board appointed by the Town Board and is responsible for reviewing and issuing rental permits for all rental properties. Property owners must obtain a valid rental permit before renting any dwelling unit or an entire home. The Board conducts public hearings on new applications and first-time renewals, ensures compliance with Town Code requirements, and may require additional hearings if there are violations or complaints. The Board’s purpose is to maintain safe, well-kept rental housing and to ensure that rental properties do not negatively impact surrounding neighborhoods. Scheduled meetings of the Rental Board meet on Wednesday evenings at 6PM in the Town Board Room at Babylon Town Hall. What is a Rental Permit?
A Rental Permit is required by the Town of Babylon to legally rent a residential dwelling unit or an entire home. Rental properties are classified as Class I or Class II, depending on the type of rental, and must be approved by the Rental Permit Review Board before being occupied by tenants.
All Rental Permits are valid for a period of two years and must be renewed prior to expiration. It is a violation of Town Code to rent any dwelling unit without a valid permit.
Applying for a Rental Permit
A Rental Permit Application must be completed and submitted to the Department of Planning and Development with all required documentation.
To apply for a Rental Permit, the property owner must provide:
- A completed and notarized application
- Floor plans for each dwelling unit
- A property survey
- A valid certificate of occupancy or certificate of compliance
- A copy of the recorded deed
- A full disclosure affidavit
- A 200-foot radius mailing
- A property maintenance certification form
If the property owner resides outside of Suffolk County, a local agent must be designated to accept legal notices on behalf of the owner.
A public hearing is required for all new applications and will be scheduled once a complete application has been submitted. Notice of the hearing will be published in the Town’s official newspaper, and the property must be posted with signage prior to the hearing date.
The application will be reviewed by the Rental Review Board, and a decision will be made after consideration of all submitted documentation and any testimony provided at the public hearing.

- What is a Rental Permit?

A Rental Permit allows a home to be legally occupied by persons other than the owner. This applies to all occupants, including family members who do not pay rent. Buildings with rental units can be a single family dwelling with only one kitchen. If the home is a legal two family by way of Certificate of Occupancy, both units may be rented and neither would be required to be owner occupied, but still requires a rental permit.

Anytime someone other than the owner of a home is the primary resident, a Rental Permit is needed. This is done to ensure that all homes are safe for others to live in and that the premises have complied with all applicable code requirements.
- What is the Rental Permit process?

To apply for a Rental Permit, you must fill out a Rental Permit Application and file it with the Rental Division. The following items will be required when you submit your application:
- Deed or duplicate Certificate of Title
- Detailed floor plans drawn at 1/4" = 1' scale
- Survey
- Certificate of Occupancy
- Identification
- Tax bill
- Building Permit application (if you intend to make changes to the dwelling or building)
- Fee ($200 for first unit and $50.00 for each additional unit)
- What are the Rental Permit requirements?

The permit requirements for rental units include:
- Smoke detectors must be placed in each bedroom, each hallway leading to a bedroom and at least one on each level of the house
- Hardwired carbon dioxide detectors must be on each level of the building
- Railings for all outside stoops in excess of 18" high
- Handrails for stairwells
- Fire-rated sheet rock for boiler areas
- Improved driveways
- No unregistered motor vehicles are allowed on the property
- Property must be in good and well maintained condition
- Storm windows
- No basement bedrooms
- Electric outlets cannot be exposed
- Tiles and grouting in bathrooms must be in good condition
- All units must have proper heat and hot water
- All Building Permits and Certificates of Occupancy must be in place and up to date
- House or building address number must be visible
